Recently, Spotify’s attorneys responded to Drake’s pre-action petition. They refuted Drake’s allegations as false.

“The basis of Petitioner’s request for information from Spotify is untrue: no such agreement exists. Furthermore, the Petition lacks legal merit and should be dismissed,” the legal team stated.

“Petitioner’s claims are speculative and lack substantial evidence,” the filing added. “The Petition fails to establish how these speculative accusations support the civil RICO, deceptive business practices, and false advertising claims Petitioner is attempting to make.”

A Spotify spokesperson also provided a statement to XXL:

“Spotify has no financial incentive to prioritize ‘Not Like Us’ over Drake’s tracks. Only one promotional tool, Marquee, was utilized for the song at a cost of €500 to promote it in France. Marquee is a visual ad labeled as a Sponsored Recommendation to users.”

Did Drake’s Legal Move Backfire?

In late November, Drake filed pre-action petitions against UMG in New York and Texas Supreme Court. The New York filing alleges that UMG and Spotify employed bots and payola to boost K-Dot’s Drake diss track numbers. Drake claims these actions violate the RICO Act, NY Deceptive Business Act, and NY False Advertising Act.

The Texas filing accuses UMG and iHeartRadio of similar misconduct, along with defamation claims. Some fans criticized Drake on social media, speculating that the legal action stemmed from bitterness over losing a rap battle to Kendrick.

Both cases are scheduled for court hearings in January.
